Despair skill completely useless

What the heck, developers, why a skill lock up to skill gem 9 now it has a rule saying "Curse does not apply to enemies above level 47".... What's the freaking point of the skill then? Basically, you can use it only for a few levels, with no end-game use for the skill.

maybe try and level the skill?
