Omen of Amelioration not working

Hi

Today wwith my character I died twice with my omen active and it didn't use up my omen so I lost 20% XP instead of 4%. Is this a known bug? Once to a boss and once in and abyss encounter. Please fix this otherwqise it makes buying and using the omen of amelioration irrelevant
